APPLICATIONS FOR DIVORCE AND/OR COROLLARY RELIEF
If the parties are not able to negotiate a separation agreement, it may be necessary to commence Court proceedings so that a Court can hear the evidence of both sides, and come to a binding decision.

Depending on your circumstances, your action may be commenced under legislation such as the federal Divorce Act, the Ontario Family Law Act, and the Ontario Children's Law Reform Act. Furthermore, different jurisdictions have different rules and procedures.

If you would like a divorce, or if your application involves property, you must start your application at the Superior Court of Justice. If you are seeking custody, access and/or support only, you have the option of using the Superior Court of Justice or the Ontario Court of Justice.
