PROPERTY
The concepts of Net Family Property and equalization payments are provided for in Ontario's Family Law Act. It is important to note that this system of property division is only available to married spouses; common law spouses must utilize other remedies such as unjust enrichment and constructive trusts.

According to the Supreme Court of Canada, same-sex couples have the constitutional right to marry if they so wish. The issue is still being debated at many levels of government, however, as it stands now, same-sex couples as well as opposite-sex couples may get married in Ontario.

In this province, marriage is seen as a partnership. Both parties are deemed to make equal contributions to the marriage, no matter what their roles or function in the family unit. A married spouse who takes on the lion's share of household and child care responsibilities will have the same right to property equalization as the spouse who makes the greater financial contribution.
